CAAB Report 128 |
Tuesday 27 July 2004 -
Harrogate Magistrates'Court -
update re application to vary bail conditions
An application was made to Harrogate Magistrates to vary the bail
conditions imposed on Lindis Percy around USAF Menwith Hill.
The application was again refused. Harrogate Magistrates imposed
the same conditions - not to cross the yellow line and not to go with 5
metres of the circumference of USAF Menwith Hill. This was despite
Inspector Penfold giving evidence under oath and admitting that the
bail conditions were uncertain. Bail conditions have to be certain
and reasonable.
We now intend to make an application to the High Court to vary
these uncertain and unreasonable bail conditions (Lindis has been
spuriously arrested 6 times recently because of different
interpretations by different MDPA officers).
