CAAB Report 129 |
Tuesday August 17 2004
The regular Tuesday night demonstrations
continue at the Main entrance to USAF/NSA Menwith Hill (now for over four
and a half years). It is so important that as many of us as possible
demonstrate to those who work on the base about our deep opposition to
what the role and functions of this base are.
Lindis Percy was again arrested by a Ministry
of Defence Police Agency officer (PC Greenwood). This time Lindis
was arrested for allegedly obstructing PC Grainge in the execution of
his duty contrary to s.89 (2) of the Police Act 1996.
Lindis was held at Harrogate Police Station
and later charged by PC Greenwood (on the 'evidence' of statements by MDPA
officers). Bail conditions were imposed by Sergeant Smith of
North Yorkshire Police and read out to Lindis by the arresting officer -
PC Greenwood. Lindis denies the charge.
The bail conditions imposed are:
(Copied exactly from the bail form)
THAT YOU ARE TO ENTER THE AREA WITHIN 15
METRES OF THE YELLOW LINE PAINTED ED ACROSS THE MAIN ENTRANCE TO MENWITH
HILL BASE ON MENWITH HILL ROAD MENWITH.
The next day Lindis requested and spoke
to Sergeant Mistledine of North Yorkshire Police concerning variations to
the police bail conditions (uncertainty and undermining of the
Human Rights Act). Sergeant Mistledown (NYP) would not
agree to any variation. He then said that the bail
conditions should have included the word 'NOT'. When Lindis again
asked the officer if he was refusing to agree to vary the bail conditions (as
the inclusion of the word 'NOT' would obviously have been a variation to
the original conditions) Sergeant Mistledine again refused the
application. In the light of this, the logical conclusion is that
the above bail conditions stand.
An application to explain, clarify
and vary these exceptional bail conditions will be made on Monday 23
August 2004 by Lindis at Harrogate Magistrates' Court.
