On arrival at the weekly CAAB demonstration at
NSA/USAF Menwith Hill, the atmostphere from the Ministry of Defence
Police Agency (MDPA) was aggressive and confrontational. It was
clear that the MDPA (Menwith Hill and the Divisional Support Group from
York) had been once again instructed to make sure that the traffic came
out of the base unhindered.
Within a short time of arriving, Anni
Rainbow and Lindis Percy were warned for different alleged offences.
Anni was warned for alleged 'aggravated trespass' (s.69 Criminal Justice
and Public Order Act - CJPOA - 1994) by Sergeant Harding and Lindis for an
alleged 'obstruction of a police officer in the execution of his duty'
(officer on 'traffic' duty).
Anni was arrested by PC Andrew Simpson for
allegedly breaching s.69 CJPOA and eventually taken by taxi to Harrogate
Police Station.
Lindis was 'reported with a view to
prosecution' for allegedly 'obstructing an officer in the execution of his
duty'. She continued to protest peacefully (lawful authority as in
the case of Hirst and Agu v Chief Constable of West Yorkshire 1986) and
was immediately arrested by two MDPA officers. She was also taken to
Harrogate Police Station. Lindis was also arrested for
allegedly 'resisting arrest'.
Both Anni and Lindis were eventually charged:
Anni - for alleged 'aggravated trespass' s.69 and Lindis for allegedly
'obstructing a police officer in the execution of his duty' and for
'resisting arrest'. Anni and Lindis will plead not guilty to all
charges.
Anni has two cases in the court and Lindis now
has 12 cases (the essence of each charge is the same - ie the right to
protest and the issue of the 'yellow line').
Thank you so much to Donna, Dave, John and
Laila for waiting patiently at Harrogate Police Station to collect Anni
and Lindis until they had been released.
