 Change of process by Ministry of Defence Police Agency

Sean Stowell (BBC Look North) was present to film the weekly Tuesday night CAAB demonstration as part of a short  item to be shown on TV on the issue of the American Missile Defence System.  It is due to go out on the day that George W Bush  is 'inaugurated' (Thursday 20 January 2005 - time to be confirmed). Anni, Laila, Dave, John and Lindis were at the demonstration.  It was bitterly cold.
 
Within half an hour of the demonstration starting,  Lindis Percy was arrested by PC Swain (Ministry of Defence Police Agency - MDPA).  This week there appeared to be another change in the way the MDPA and Derek Day (Custody Sergeant) processed the pre-arrest and outcome.  
 
For four weeks running, Lindis has been 'warned', 'reported with a view to prosecution' and then arrested for various alleged offences concerning 'obstruction of the highway' or 'obstruction of a police officer in the execution of his duty'.   She has been held long enough for the demonstration to finish and then released without charge.  This was an intolerable position for the MDPA to take, which prompted a letter by her solicitor Richard Reed, to say so.
 
Tonight Lindis was charged for allegedly obstructing the highway.  She was not 'reported with a view to prosecution'.   This is the eighth consecutive week that she has been arrested.
 
A short time later Dave was arrested under s.69 'aggravated trespass' (Criminal Justice and Public Order Act 1994) and later charged,  after declining to have his finger prints taken.  There were no other arrests and the demonstration continued until 8 pm.
 
Unusually,  Chief Inspector Steve Barlow (MDPA) also appeared.
 
Anni and Lindis are in Harrogate Magistrates' Court tomorrow (19 January 2005) for a Pre-trial hearing (PTR).  We had hoped that the District Judge who would eventually hear the trials (22 cases are now in court over the same issue) would be at the pre-trial hearing.  We heard last week that the Lord Chancellor's office need 6 weeks notice to appoint a District Judge.  No DJ could be found so the case will yet again be adjourned so as to fix a new date for another PTR.  The original charge was on 18 May 2004.
 
Dave and Luke are also in court - Luke on Wednesday (PTR) and Dave on Thursday and 27 January 2005 for a 'plea' date after tonight's charge.
 
NB: 
CAAB will be at the main entrance to NSA Menwith Hill on Thursday 20 January, 6 - 8pm 'inauguration' day of George W Bush.
