Harrogate Magistrates' Court
DAY 6
Having been found guilty of 5 offences (1
x 'obstruction of the highway' and 4 x 'obstructing a police officer
in the execution of his duty') yesterday, Robert Moore
(Crown Prosecutor) made an application, said to be on behalf of the
Ministry of Defence Police Agency and North Yorkshire Police, for an
Anti-Social Behaviour Order (ASBO) against Lindis Percy.
Robert Moore (CP) said he did not have to
call any witnesses to give evidence in support of the damming application
against Lindis. District Judge Roy Anderson said that on
the evidence he had heard and looking at the list of convictions Lindis
has he did not want to hear any more evidence. He agreed only
to paper references that could be submitted on behalf of Lindis.
There were five Ministry of Defence Police
Agency officers in court including Chief Inspector Penfold. This
officer had been at Menwith Hill on Tuesday night during the weekly
Tuesday night CAAB demonstration. The officers 'policing' the
demonstration had upheld the right to protest as defined in the case of
Hirst and Agu v CC West Yorkshire 1986 - refer to CAAB Report DAY 3.
When Chief Inspector Penfold came out of the
base in his car, an MDPA officer held up the car, allowed Lindis to stand
in front of his car and she then stepped to one side. In court
today, Robert Moore said that the demonstration was 'as usual'. We
were not given an opportunity to show the video. Richard Reed
(Solicitor representing Lindis) asked that this particular video be
'preserved' so that the video could be shown to the District Judge at a
later date.
Roy Anderson (District Judge) ordered that a
pre-sentence report be obtained on Lindis by the Probation Service before
the next hearing, increased her bail conditions and
said he was '...leaving all sentencing options open...'.
The hearing was adjourned until 17 May 2005 at
Harrogate Magistrates' Court when the hearing will be resumed for the
application of an ASBO against Lindis.
This application has serious implications for
us all.
