On 5 November 2005, Lindis Percy was issued
with a alleged 'warning' notice by a Ministry of Defence Police Agency
officer - not to return on land at RAF Fylingdales within three months
(s.69 'aggravated trespass' - Criminal Justice and Public Order Act
1994).
Lindis was eventually arrested at
Fylingdales on Saturday 7 January 2006 for allegedly being in
breach of the s.69 notice. She was denied bail and was detained in
custody at Scarborough Police Station until Monday 9 January 2006 when
she appeared before Scarborough Magistrates. She was released on
conditional bail - 'not to go within one mile of RAF Fylingdales
perimeter fence except on 4 March 2006 for the purpose of going directly
to and from and attending the Quaker Meeting on that date' [Quaker
Meeting for Worship].
For many years the Ministry of Defence
Police Agency have refused to discuss anything about the Military Land
Byelaws at Fylingdales - new byelaws are to be brought in because the
old byelaws are invalid. Instead of using byelaws (the MDPA insist
that the byelaws are in force and notices round the base inform the
public that they are - the police know them to be invalid)
'aggravated trespass' has been used instead. Section 69 can be
thought of as a form of 'bail conditions' and has been used often
against Lindis over the years. There is a long history of deeply
concerning manipulation and abuse of these laws by the Ministry of
Defence Police Agency.
