CAAB Report 185 |
Wednesday 18 January 2006
Lindis Percy was arrested last night at the
weekly Tuesday evening CAAB demonstration for being in breach of the
unsafe bail conditions re-imposed by Harrogate magistrates on Monday.
The bail conditions:
'You will not approach within fifteen metres of the MOD boundary at RAF Menwith Hill as defined by the perimeter fences, hedgerows and gates, and to include the yellow line painted on the ground outside the Main Gate; except to traverse these roads in a vehicle without stopping unless to comply with traffic lights or the directions of Police Officers.'
The CAAB demonstration is held at the main entrance to NSA Menwith Hill.
Fifteen metres from the main entrance would place Lindis on an uneven narrow 'verge' with a fast unlit road in front of her and a ditch and barbed wire fence behind her. It is a position that MDPA officers were never happy to (and if fact no longer do) stand in.
After much thought and mindful that the court upheld her right to protest Lindis decided to go to the demonstration and ask the MDPA officers if they would agree to her standing in a safe position. They refused.
Instead Lindis was given the option of leaving the area, standing in the unsafe position or being arrested. The first two options were untenable as they prevented her from peacefully protesting. She was arrested and taken to Harrogate police station where she is being held in custody overnight and will be taken to Harrogate Magistrates' Court later this morning to answer breach of bail. The hearing could take place at any time during the day as there is no fixed time.
