Curfew Lifted on Lindis
 
Lindis Percy was in court for a 'plea' hearing after being charged with an alleged breach of a s.69 warning purported to have been given by PC Woodhouse (Ministry of Defence Police Agency) after being assaulted by American military personnel at USAF Croughton on 19 February 2006 - refer to CAAB report 188 on website.   Bail conditions were imposed.  Sergeant Kirby (Custody officer - Northampton police at Banbury police station) gave his reasons below for why he thought a curfew (10pm - 6 am at home in Hull) was necessary (copied exactly from custody record):
 
DIP has long career of offending particularly targeting military establishments as part of her political campaign.  Having reviewed previous offending this is ongoing and D/P shows little if any remorse.  Offences regularly take place in the evening or over night all over the country at military sites.  On 18/2/06 D/P attended Moldsworth RAF base in Cambridgeshire where she was issued s.69 warning for Aggravated Trespass.  From here she travelled to Northants where she once again committed offence of agg trespass.  Here she was arrested.  The curfew therefore intends to prevent D/P traveling to or from sites during evening or overnight.
 
This is essential to prevent further offences, to deal with issues of National Security and to ensure welfare of D/P as she is trespassing on High Risk sites at a time where security is at high alert.  Some sites have armed security.
 
The exclusion order is intended to prevent further offences at RAF Croughton as I believe D/P is at high risk of re-attending site to commit further offences.

Lindis entered a plea of 'not guilty' and an application to vary the bail conditions was made.  The Crown Prosecutor said that he thought the curfew was 'inappropriate' and instead asked the Magistrates to consider the following bail conditions:
 
Not to enter the following premises - RAF BASES - UNITED KINGDOM WHERE USAF MEMBERS ARE BASED
 
1.  RAF Croughton, Northamptonshire
2.  RAF Barford St. John, Oxfordshire
3.  RAF Fairford, Gloucestershire
4.  RAF Welford, Berkshire
5.  RAF Mildenhall, Suffolk
6.  RAF Lakenheath, Suffolk
7.  RAF Alconbury, Suffolk
8.  RAF Molesworth, Suffolk
9.  RAF Menwith Hill, Yorkshire
10. RAF Fylingdales, Yorkshire
 
The Magistrates duly imposed these bail conditions on Lindis.
 
An English 'observer' and Eileen McAdam (Sergeant - MDPA) from USAF Croughton were sitting at the back of the court during the hearing on behalf of the US authorities.
 
After the hearing Lindis went to USAF Croughton and peacefully demonstrated for over an hour at the main gate, holding a US upside down flag with the words 'INDEPENDENCE FROM AMERICA' written on it.  She was joined by a resident of Croughton.

Although all US bases are known as 'RAF', the list above are all bases occupied and controlled by the US Visiting Forces and their agencies.
 
These bases operate 24 hours a day and therefore Lindis monitors them at any time of the day, evening and night.
